Abraham’s Children Foundation is an NGO registered in Nigeria in 2011 with head office in Afikpo, Ebonyi State Nigeria. Abraham’s Children Foundation had signed Declaration Against Corruption that states:

We will support candidates for public office who say no to corruption and demonstrate transparency, integrity and accountability

With respect to 1999 Constitution of Federal Republic of Nigeria provision in Section 17 (1 and 2), all Federal Public Officers and Citizens of Nigeria are equal before the law. It will amount to abuse of the State Social Order of Equality and Justice if the above provision is not invoked in the prosecution of Serious Misconducts by Venerable Dr. Ogbonnia Ibe-Enwo as it currently been implemented in the prosecution of a Director of Federal Ministry of Education Mr. Victor Igboanugo by Independent Corrupt Practice and Other Related Offences Commission (ICPC), former Secretary to the Government of the Federation Engr. Babachir David Lawal by Economic and Financial Crime Commission (EFCC) and Retired Chief Justice of Nigeria Honourable Justice Walter .N. Onnoghen by Code of Conduct Tribunal (CCT). Corruption fueled terrorism, Kidnapping, banditry and all current violent crimes in Nigeria and if every Nigerian becomes corrupt there will be no nation call Nigeria. Corruption – the abuse of entrusted power for private gain – is wrong.
It destroys the basic rights of hundreds of millions of people across
the world, it has devastating consequences on the services provided by
public institutions and it undermines the prospect for a better life for future generations. We believe together we can work towards ending corruption, overcoming widespread injustice and impunity. All forms of corruption must be ended to secure the basic rights of all people and ensure a world where everyone can live in dignity.

Evidence backing our letter to Acting Executive Economic and Financial Crime Commission (EFCC) Abuja Nigeria that is attached to this press release will be provided by Abraham’s Children Foundation if contacted by email.

We hereby call for action by both State Actors and Non-State Actors in the implementation of Open Government Partnership (OGP) National Action Plan with respect to Anti-corruption commitment.

GROSS ABUSE OF GOVERNMENT INTEGRATED FINANCIAL AND MANAGEMENT INFORMATION SYSTEM (GIFMIS) BY THE PARALLEL GOVERNMENT OF MANAGEMENT OF AKANU IBIAM FEDERAL POLYTECHNIC UNWANA: REQUEST FOR INVESTIGATION, PROSECUTION AND RECOVERY OF STOLEN SALARIES, ALLOWANCS AND BENEFITS OF STAFF OF THE INSTITUTION BY FEDERAL GOVERNMENT AGENCIES AND CIVIL SOCIETY ORGANIZATION.

Further to our letter on the above subject matter with reference ACF/SEC/PenCom/Vol. 1/ 3A (dated 4th January, 2019), we write to draw your kind attention to the continuity of the unlawful Pension double deduction by the parallel government of Management of Akanu Ibiam Federal Polytechnic Unwana in January and February 2019. In line with our Human Right Defender role in defence of Universal Rights to life through Federal Public Officers livelihood of full salaries and benefits, we hereby present Exhibits of official documents in support of National Pension Commission letter to Executive Director Abraham’s Children Foundation with reference: Pencom/DG/CSLD/2018/TR69 dated 18th December 2018 on the above subject matter. In line with our Non-State Actor role in the Co-implementation of the Open Government Partnership (OGP) Nigeria National Action Plan with respect to Anti-corruption commitment, we hereby state:

1. That if Federal Public Service disciplinary action for Serious Misconduct (as defined in Public Service Rule 030401 and 030402 in line with1999 Constitution of Federal Republic of Nigeria Section 14 (5) that states: “The State shall abolish all corrupt practices and abuse of power”) is not respected by the State Actors in Ministries Department and Agencies (MDAs) in line with their OGP National Action Plans commitment on Anti-Corruption, the Non-State Actor will first report these Serious Misconduct to President Muhammadu Buhari using all possible media of communication including  peaceful protest and campaign on social media globally before going to court to seek damages on behalf of Staff of Akanu Ibiam Federal Polytechnic Unwana. We will draw the general public’s attention to Section 14 (1) of the Constitution that states: “The Federal Republic of Nigeria shall be a State based on the principle of democracy and social justice” and speak out for equity in the prosecution of cases of Serious Misconducts by public officers with respect to Chief Justice of Nigeria as compared to that of Management of Akanu  Ibiam Federal Polytechnic Unwana. Our Human Rights Defender Blog (that will be linked to it via social media) will begin publishing of our campaigns on this issue for global audience attention action.

2. That Public Service Rule 030401 defines Serious Misconduct as a specific act of very serious wrongdoing and improper behavior which is inimical to the image of the service and which can be investigated and if proven, may lead to dismissal. If this definition is acceptable to MDAs in Federal Public Service, then these are evidence based Serious Misconducts of Management of Akanu Ibiam Federal Polytechnic Unwana for State Actors to take the  needed Public Service disciplinary action to end the on-going stealing from Federal Treasury, Staff Salary and Student fees.
A.   Suppression of records of Agencies of Federal Ministry of Finance, Budget Office of the Federation and National Pension Commission. (Please see EXHIBIT 1, 2, 3, 4 & 5)
B.   False claims against Government officials (in A above) as presented in Management of Akanu Ibiam Federal Polytechnic Unwana Memorandum to all staff of the institution with title: “Delayed payment of June 2016 Staff Salary” with references AIFPU/REG/MGTC/175/VOL.63/18 dated 4th July 2016 and AIFPU/BUR/2016/30 dated July 11, 2016. (Please see EXHIBIT 6,7,1)
C.   Bribery, Corruption and Misappropriation of salary and benefits of staff and school fees of Students. The Governing Council of Akanu Ibiam Federal Polytechnic Unwana and Tertiary Education Department of Federal Ministry of Education are aware of these Serious Misconducts with no disciplinary action taken on the Management of Akanu Ibiam Federal Polytechnic Unwana (Please see EXHIBIT 8)
D.  Embezzlement of approximate estimate of N 682,511,632.17 based on our analysis of figures obtained from GIFMIS Warrant for 2016, 2017, 2018 and 2019 estimate based on 2018 figures. (Please see EXHIBIT 3,4 & 5)

E.   Divided loyalty, Sabotage and Action prejudicial to the Security of the State. (Please see EXHIBIT 9)
F.   Any other act unbecoming of a Public Officer. Deceitful acts of the Rector of Akanu Ibiam Federal Polytechnic Unwana to Union Leaders and Staff that he will issue a circular to explain to staff that shortfall in personnel grant by Federal Government made Management not to implement directive by Federal Ministry of Education to pay full salary to staff in January 2019 and this re-occurred in February 2019. In a Press Release by Ukegbu Chibuzo Chimezia, the Publicity Secretary of Academic Staff Union of Polytechnics (ASUP) Unwana Chapter (after the meeting of the Unions with the Rector on 30th January, 2019) states: “the ASUP Excos met with mgt alongside the leaders of our sister unions on campus; SSANIP and NASU. The mgt informed us that there was a shortfall in our salaries this month. Mgt explained to us that govt reneged on the promise it made to increase personnel cost to accommodate the PAA, as regards the circular released earlier by govt. The money released this month cannot pay our normal increment and promotions let alone the PAA. We were told that it can only pay the salary we received in December 2018. That whenever govt fixes the problem, mgt will pay the difference. Meanwhile mgt said it has reported to the appropriate authorities about the shortfall. A memo to this effect will soon be made to enlighten members of staff on this issue as agreed with the mgt.” (Please see EXHIBIT 10)
Federal Ministry of Education circular to All Rectors and All Provosts with the subject: “Payment of Salaries and Allowances” (Ref: FME/PSE/201/C.2/VOL.11/142) dated 3rd January 2019  states: “Sequel to the enhanced personnel budget under 2019 Appropriation you are to ensure full payment of Salaries and Allowances to eligible staff to maintain Industrial harmony within your institutions. This is without prejudice to existing arrangements to ensure that all categories of staff are paid as when due”. (Please see EXHIBIT 11)

3. Management of Akanu Ibiam Federal Polytechnic Unwana as a parallel government to President Muhammadu Buhari led Federal Government of Nigeria does not take orders or directives from Federal Ministry of Education, but rather respects and upholds internal decision of Governing Council based on recommendation by Joint Council/Management/ASUP Committee on payment of owed allowance in the polytechnic. This message was conveyed through a memorandum by the Registrar/Secretary to the Council to the Rector, with reference AIFPU/REG/GCM/158/VOL.46/205 dated 29th January 2019, he states: “I write to inform you that the 8th Governing Council at its 8th Regular Meeting held on Wednesday, 23 January, 2019 considered the Report of the Joint Council/Management/ASUP Committee on the payment of owed Allowances in the Polytechnic. Council approved the recommendation of the Joint Committee and directed that Management should ensure the payment of 3months arrears of Peculiar Academic Allowance per quarter in 2019 and if Management, at any time is unable to meet this obligation, Management should communicate its position on the matter to ASUP and other staff unions in the Polytechnic accordingly”. (Please see EXHIBIT 12)

4. That the Rector of the Institution’s unbecoming act of deceit resulted in his use of approval of the Governing Council recommendation of Joint Council/Management/ASUP Committee on payment of owed allowance in the polytechnic as a basis to continue the unlawful pension deduction of 7.5%, Peculiar Academic Allowances of 7.5%, Peculiar Non-Academic Staff Allowances of 5.2%, Non-implementation of normal yearly salary increment and Non-implementation of promotion salary increment for affected staff of Akanu Ibiam Federal Polytechnic Unwana.

5. That Management of Akanu Ibiam Federal Polytechnic Unwana and their friends in MDAs that provide them protection should be identified and declared Internal Enemies of the State and their on-going parallel government activities of stealing and cover-up should be stopped forthwith. 

6. That an evidence of the activities of the Management of Akanu Ibiam Federal Polytechnic Unwana parallel government activities known to Tertiary Education Department of Federal Ministry of Education is that they have a different Public Service year calendar for staff appraisal and promotion exercise. This is the case for the last six years.

7. That in line with the monitoring mechanism for the implementation of Open Government Partnership with respect to Anti-Corruption, Fiscal Transparency in governance and Freedom of Information by the State Actors and Non-State Actors, we call on State Actors to:

·        Investigate and take action on the allegation put forward by Management of Akanu Ibiam Federal Polytechnic Unwana that their budgeted allocation for Personnel Cost was under remitted by Federal Government Agencies charged with these responsibilities, that warranted the Institution’s Management to make double Pension deduction from all staff salaries in the month of January and February 2019. This new dimension of allegation against Federal Government agencies that warrants the Management to make 7.5% double Pension deduction from staff salaries and not to pay 7.5% Peculiar Academic Allowance, 5.2 Peculiar Non-Academic Allowance normal increment, promotion increment in January and February  2019 is unacceptable to us as Non-State Actor in OGP National Action Plan for Nigeria.

·        Investigate and take action to stop the untimely issuance of pay-slips to staff of Akanu Ibiam Federal Polytechnic Unwana. This has been going on for a long time because Management of the Institution has something to hide. The last time pay-slips were issued to staff of Akanu Ibiam Federal Polytechnic Unwana was that of November 2018 released in February 2019, pay-slips for December 2018 to February 2019 are yet to be issued to staff. Sample of pay-slips between May 2016 and August 2018 has already been forwarded to State Actors for investigation and necessary action of prosecution as demanded by Criminal laws to serve as deterrent to others. The State Actors should make Management of the Institution and their friends in MDAs know that justice must be done either by President Muhammadu Buhari led Federal Government of Nigeria or God the creator of all mankind in the hereafter, there is no place to hide because universally crime has no time bar in criminal code of Nations and that of God Al-Mighty.

PRAYERS:

·        In line with Public Service Rule 030402 listed Serious Misconducts with respect to False claims against government officials, Suppression of records, Action prejudicial to the Security of the State, Divided loyalty, Sabotage, Corruption, Embezzlement and Acts unbecoming of public officer, we pray that the parallel government of management of Akanu Ibiam Federal Polytechnic Unwana false allegation against Federal Government Agencies with responsibility on implementing Pension Reform Act at the institution be prosecuted and millions of naira stolen through double deduction be recovered for staff of the institution through the OGP Co-implementation of National Action Plan on Anti-corruption by State Actors (Federal Government Agencies) and Non-State Actors (Civil Society Organizations).

·        We pray that in line with constitutional provision for equal treatment for all citizens, the urgent action taken by State Actors to prosecute criminal charges involving the Chief Justice of Nigeria be extended to Management of Akanu Ibiam Federal Polytechnic Unwana with respect to double deduction from staff salaries since June 2016 till date.
·         We pray that urgent action be taken by the State Actors to prevent Non-State Actors from using Peaceful Protest in Abuja and the Social Media to raise the general public voices for President Muhammadu Buhari to take action to end the open stealing of Staff salaries by Management of Akanu Ibiam Federal Polytechnic Unwana parallel government through double deduction of 7.5% Pension.
·        We pray that investigation be carried out to recover embezzled public funds and staff salaries used by Management of Akanu Ibiam Federal Polytechnic Unwana for bribery in the name of Public Relation in MDAs and support for hidden political activities involving management of the institution that goes against national interest of the State.

·        The Rector of Akanu Ibiam Federal Polytechnic Unwana is the representative of the President of Federal Republic of Nigeria. We pray that all actions necessary be taken to stop the Rector and his management associates from giving President Muhammadu Buhari and Federal Government Agencies a bad name and image before staff of the institution as reported to Federal Ministry of Education and the Governing Council in EXHIBIT 9 and no action taken till date to correct the situation.

The Centre for Anti-Corruption and Open Leadership, CACOL, has backed the decision of the Independent Corrupt Practices and Other Related Offences Commission (ICPC) to arraign Mr. Victor Igboanugo, a Director in the Federal Ministry of Education.


This was contained in a statement issued to DAILY POST by CACOL’s Executive Chairman, Debo Adeniran.


The statement added, “The 17-count charge brought against Victor Igboanugo, who was charged before an FCT High Court, in Apo, bordering on money laundering involving a huge sum of N162 million, was another bold step in tackling the hydra-headed monster of corruption in the country, because for every millions of Naira stolen or misappropriated by any Government official and their cronies, millions of Nigerians are directly deprived of access to education, good roads, electricity and other social amenities, and right to a good Medicare.


“Like Caesar’s wife, those who have being put in positions of public trust must rise above board by accounting for every penny in their care.


“We commend ICPC for their patriotic zeal to rid our land of evils of corruption and provide the accused the opportunity to clear their names if they are innocent of the charges preferred against them.


“It is a good work well-done by the ICPC, to have been able to put Igboanugbo on trial over ownership of property valued above his legitimate income and the alleged contract frauds to the tune of N162 million, which was made known to the court by the ICPC counsel, Henry Emore.


“He told the court that the accused, while being the Secretary of the Ministerial Tender’s Board at the Ministry of Environment, facilitated the award of multiple contracts of private companies where he held personal interests.


“We advise that this case and many others should be clinically, diligently and fairly prosecuted, and properly concluded.


“If the accused is found guilty, he should be made to suffer for his wicked acts, while proceeds of the crime should be completely retrieved and repatriated to their original source, in order to relief long-suffering Nigerians and serve as a deterrent to others.”
